Darrin Fernandez is serving a 10-to-15 year sentence for rape - he climbed a fire escape and went through an open window in Boston and raped a girl in 2000, and was convicted in 2003.
He's had *two* hung juries on another rape case where, 8 months after, in the same neighbourhood as the first case, a man climbed a fire escape, entered through an open window, and raped the girl. DNA evidence matches Darrin Fernandez exactly - there is absolutely no question that the DNA matches his precisely - but the juries have hung because they can't prove it *wasn't* his identical twin brother.

Date: 2005-08-26 09:46 pm (UTC)Are the juries allowed to know about the previous conviction? Without that, and it really is circumstantial at best, it's really frickin' hard to consider it proven beyond a reasonable doubt. Unless the identical twin can be proven to have been elsewhere.
