Yes. Yes it can.

There are some extremely stupid cases where exactly this can and has happened.

And regardless of it not being anything that *should* be against the law, it's still a serious crime in the USA if you're poor and not related to a Governor.

If it helps any, he should probably have been charged with indecent exposure, too.
