I think that's a red-winged black bird based on the red & yellow stripes on it's wings. I'm also wondering if it isn't a chop. The shadow under the smaller bird looks a funny.
Actually- I've seen blackbirds "Mobbing" a hawk that way- his wings are partially spread and if his tail is spread out for balance- the shadow is right. Though the timing on this shot had to be perfect to catch it this way...
