Supreme Court Rules that Presumptive Adult Sentences for Youth Offenders Are Unconstitutional

Because, fundamentally, requiring that an offender prove that aggravating circumstances are *not* present, rather than requiring the Crown to prove that they *are* present is a violation of "the right to life, liberty and security of the person and the right not to be deprived thereof except in accordance with the principles of fundamental justice", and said violation cannot be "demonstrably justified in a free and democratic society."
