to be fair, it's worth noting that Allstate doesn't want to pay for damage that is not covered by the homeowners' policy, as they didn't have flood insurance..

Allstate is claiming that all the damage was flood damage, in fact. The homeowners are suing because they think Allstate is ducking the claim and blaming the flood for non-flood damage.

And either way, it's a stupid decision to use people *whose claim you are denying* in your ad about how awesome you are.

Sadly, a pretty typical tactic with insurance companies and hurricane damage. And, in my direct experience, any sort of water damage not from a burst pipe. Their definition of flood is different than most average people's.
