They're not giving up gmail.com.

They're agreeing not to advertise gmail in the UK, and presumably ceding the claim to gmail.co.uk. In the UK, "GMail" is not "Google Mail".

An analogy: For some reason, Microsoft runs into a company in the UK that produce a product called "Encarta", and has produced it for longer than Microsoft.

They can't agree on a deal for MS to buy the name, so, in the UK, MS does not produce or sell "Encarta", they sell the identical-in-all-ways Microsoft Encyclopedia. They don't have to give up Encarta.com, but they would probably be prevented from buying encarta.co.uk or a variant.

But they've lost the rights to use the name "Gmail" in the UK. Giving out gmail.com addresses in the UK, even though they own gmail.com, would necessarily involve presenting Google's product as "Gmail" - and in the UK, "Gmail" refers to the other company's product, not Google's.
