His jaywalking caused the accident, so I'm surprised he only got a ticket. The article doesn't indicate that it delayed his getting medical attention, and does mention that he was taken to hospital. While it strikes me as something like overkill, it doesn't shock me.
If he were a guy who'd been shot by a cop after shooting (or shooting at) other cops (to give an extreme example), you can bet he'd be read his rights and officially placed under arrest before being taken to hospital, or while being given emergency medical care.
