US Supreme Court rules that holding military tribunals (with no counsel, witnesses, or evidence for the defence allowed) for prisoners is not, in fact, legal.

The ruling was split directly along partisan lines, with the real judges who read and apply the law in favour and the Batshit Loonies (Scalia, Thomas, Alito) against. Roberts was forced to recuse himself after it was pointed out that he worked for the government on this case and was blatantly prejudiced because of it.

Does that mean that the people who held them are criminals?

One of the dissenters, Justice Clarence Thomas, took the unusual step of reading part of his opinion from the bench, saying the decision would "sorely hamper the president's ability to confront and defeat a new and deadly enemy".

I love how his dissenting opion is based on "we much let the president do whatever he wants," rather than the "law and justice says this." ... WTF?

From what I remember of my law teacher, he'd think that arguement was total BS. And he was pretty right-wing. Nice guy. One of the few real conservatives I get along with.

But, yeah. For a Supreme Court Judge's dissent to be "We need to let the prez'nit break the law" is disgraceful.

i've seen quite a few level headed conservatives... just not in the public spotlight...

You're confusing "conservative" with "republican". The two are completely mutually exclusive. One cannot be a conservate and be a republican, and one cannot be a republican and be honest.

Actually i used "conservative," because [livejournal.com profile] siv_volk said, "One of the few real conservatives I get along with." It was a direct response to that statement.

As for the rest.. in the modern situation, i think BOTH Maerican parties are made up of fucked up lying self-interested bastards... the last time i was asked what i thought about the government i said, "i think the Republicans are driving this coutnry into the ground with corruption and the democrats don't have the balls/brains to do anything about it."

Blaming the Democrats for this is almost identical to blaming a battered woman for not leaving her husband.

i think it's different, because i see the democrats as failing, due to incompetence and disorganization... they as a party, don't seem to have any direction or leadership... at least among their top people...

not to mention, they aren't battered wives.. they are people who came up and said they could lead this coutnry. they got their chance and aren't doing a very good job of it...
