OK, I'm confused. Google is a search engine. If the case did go to court, would they really be guilty of copyright infringement? To take it another way, there are a lot of sites online that I'm sure violates Lucasfilm's copyrights. I'm also sure that Lucasfilm directly contacts the worst offenders with a cease and desist order. But I'm also sure that Lucasfilm at least partially uses Google to find said worst offenders. The idea of suing the search engine for copyright infringement sounds too weird, to me.
They can't sue Xenu - they've tried, and the Dutch laughed them out of court. The DMCA, though, is so broad that you *can* sue a search engine for *linking to pages* that contain copyrighted material.
The DMCA applies not only to violators, but to people who link to violators.

Worse, Google would have to prove that Xenu does *not* violate copyright in order to not be held accountable - and while Xenu can prove that they're not violating copyright themselves and thus absolve Google of liability, doing so would require agreeing to be bound by a US court regardless of the outcome.
It's an absurd piece of legislation, written by idiots who know nothing about what they're legislating and are, in fact, just parroting what the marketing weasels who contribute to their campign tell them to say. It's just like CAN-SPAM and PATRIOT, that way.

I recently read a collaborative short story that was posted on thr internet, set in the near future when internet access in the US is very much china-ised and unrestricted feeds are brought in over the border from canada using wireless links and technoninjas/terrorists maintaining said links. Anybody know what that was?
