I hope the smoker wins. Corporations have no business telling their employees what they should or should not do when the worker isn't on the clock, especially when it is a legal activity.

I was going to mention the same thing. Even besides the fact that he got the wrong damn chromosome, it's priceless. How does that go?

Employer:"Well, everything looks in order. We'd love to hire you! You just need to pass this drug test." *Later* "We got the results back, and it turns out that you're a woman. I'm sorry but we're going to have to let you go. Our policies clearly state that we only employ heterogeneous chromosomed people."

Still, it is none the their damn business if he can do the job.
