The thing about Scalia is, he's a big fan of Warren Burger's whole Guilt/Innocence approach. Where the goal is making sure guilty people only go to jail, and innocent people only go free, without error. That's it. It sounds good, until you notice what was left out. Rights, procedure, rules of conduct, really any restrictions whatsoever on police power are counter to this philosophy - and of course, one must always assume that police are forever honest and pure and never abuse or misuse power. It's a shocking combination of "The ends justify the means" and sheer balls-to-the-wall naivete.

Y'know what I like? Ann Althouse posted this on her blog without comment, which is odd because she usually makes her opinion abundantly clear. As most of the comments defended Scalia and endorsed 24 as valid moral scenario, her silence becomes clear - she couldn't risk offending her fans by calling Scalia a wackjob, but she couldn't risk openly endorsing such bullshit either (seeing as how she is a law professor).
