The thing is, from what the article described, it wasn't that he was masturbating that was the problem. It was that he had on 3 occasions whipped it out in full view of the guard station (and apparently that particular female guard), knowing that he could be seen. That's not quite the same thing as doing it while lying quietly in your bunk and creating privacy with a blanket or whatever.
