Oh geez, see, normally I'm tooootally on the side of the people wanting their musical rights, since they're usually not taken nearly seriously enough. But COME ON people. This isn't like Napster or something where people are downloading the songs illegally and for free - it's just an alternative distribution style.
The part that makes me amused is that he's suing *Apple*, and not *Universal* - when the problem is that he's claiming Universal doesn't have the right to sell download rights to his music. Apple have a contract with Universal to sell Universal's music catalogue online. Eminem's music is part of Universal's catalogue. Therefore, Apple is selling Eminem's music after legitimately buying it, in good faith, from the people who sell Eminem's music. Eminem's dispute is with his record company for selling rights to his music that they don't have, not with Apple.
A C+D to Apple accompanying his lawsuit with Universal, with pursuit of an injuction against Apple as part of that lawsuit, I could see. Even suing Apple if they don't comply with the judicial order to stop, sure.
I'm pretty sure he doesn't have any standing. His music belongs to whichever RIAA member he sold himself to. If he doesn't like that, well, he should've thought about that before he decided that he preferred fat sacks of cash to owning his catalogue.
