I would really like to know why common sense isn't.

Ain't it usually a condition of the sentence that the offenders in a case like this are *not* *allowed* to be within xxx feet of schools/children/etc.?

Possibly, but here's the catch:

* The community service was for a completely unrelated crime
* The person assigning community service didn't read his record
* His previous offenses were decades ago in a country that doesn't exist any more.

So, while that is a usual condition, it wasn't at the time, it wasn't the cause of his community service, and I really can totally understand the fuckup. Not condone it, mind, but I can see why it happened. It's not quite so blatantly stupid as it sounds.
