They can charge all they like. The question is -- will a good judge summarily dismiss the case on the grounds that the Supreme Court has already said "fuck you up the ass! AND go blow yourself" to sodomy laws.

The other thing is, a law that is on the books but that has not actually been challenged in courts will remain on the books until it is struck down. Overturning the law in Texas does not have an immediate effect on Alabama. Or rather, wouldn't if the Alabama definition was along the same lines. As you rightly point out, it isn't.

According to the Code of Alabama website, sodomy in the first degree is still on the books as a class A felony. No updates are recorded to the 1975 edition of the Code.

An amusing tidbit: If you have deviant intercourse -- now I want to see their definition of "deviant" -- with someone under 12, it's aggravated sodomy, a class A felony. If you have deviant intercourse with someone under 16 but over 12 it's sodomy, a class B felony. What about having deviant intercourse with someone on their twelfth birthday?

Even if he did commit some heinous crime and freeze some woman's parts in his freezer, he shouldn't be punished just because of his incredible acting ability. Who hasn't planned to dismember and freeze somebody? The only difference is that he's famous, and that means his crimes don't count.
