The Johnny Depp (and phillip seymour hoffman as The Penguin) issue was brought up in one of Perez-hilton's post...as far as i know, he's usually right on the money..
He predicted Heath Ledger was going to be the Joker and that two-face was going to be the villain almost as soon as "Batman Begins" came out...
I drew one of the banner cartoons of Perez (I know him as Mario Lavendeira from Westchester, Florida), we've run in similar social circles and he's one of my celeb patrons.

Studios *do* plan 3 years out, and announce things. They rarely create posters, however, and that specific title is unlikely given the comic of the same name.
I just hope that they never ever introduce Jervis Tetch to this universe. Or if they do - he needs to be another billionaire playboy driven crazy by Al-Goul, so he has a pre-occupation with riddles.

I would argue that Jim Carry did an awesome job as the Riddler, given the more Animated-Series-esque Batman (as opposed to the current, darker, graphic novel style). Though I didn't like Two-Face in that movie; nothing against Tommy Lee Jones, I just didn't like the doubling of the Riddler and Two-Face in one movie.
