He's not law enforcement, not investigating a crime, and not using those tapes as evidence against them. Instead, those tapes are evidence that he produced completely on his own, and they're exactly as admissable as, say, child porn tapes would be, or home movies of himself violating a dead pig.
Besides, I'm pretty sure Algerian law doesn't have remotely the same rules of evidence as the USA.
