He came into the country witohut permission and wasn't "adopted" - there was no oversight or agency involved, no paperwork, etc. The Kent's claimed him as their own.
Americans can claim orphaned babies any time they want. Especially if they're foreign babies. That way they can become Americans and thus good and not bad. Bad being foreign. I'm pretty sure its in our Constitution somewhere. Just ask Madonna or Angelina Jolie if you don't believe me...
