In the race to find a reason to laugh this idiot out of court, the "words and short phrases" doctrine beats out the "facts" rule by a hair. Fair use lags in the back, seeing no reason to come poking its nose in when there are simpler rules that can do the job.

He was only in the South Dakota State House of Representatives anyway. Thats like the City Council of a real state.
