It's LIKELY that this is innocent - two different copies arriving in different states and different times. Maybe one of them has the manual and the other doesn't. Maybe the back of one box has water damage on the insert or the plastic is scratched up. Maybe it's just "the price changed between those two copies going on the shelf and one of them hasn't been updated".
Here's the thing: If the PS3 copies are anything like XBox copies, that cover is reversible. In fact, guess what was the first thing I did, even before I left the store at the midnight release party.

Yeah I challenged an EB games employee on their used games pricing schemes. The answer I got was similar to what was explained above. The more expensive used game may be in its original packaging, with the manual intact. The cheaper one may have scracthes on the disk, damage to the cover, etc.
More than likely, the price is determined by what the store "lost" in the original trade-in for the item. Or it could be a simple marketting ploy to fool the consumer into thinking that the slightly more expensive video game is in better condition.
