I am generally opposed to the pre-checked boxes for the "Sign up for our newsletter/e-mail list/whatever" nonsense, so this can only be a good thing that will be carefully studied and promptly ignored by our corporate-owned Congresscritters.
No matter what you think about the EU (and a lot of rude things can be said about the Common Agricultural Policy, although I believe it's slowly getting better), their general attitude towards personal privacy rights is pretty good and should be emulated.
That sort of shit gets pulled regularly in software installs. "Oh, you *didn't* want our custom toolbar installed in your browser? Should've unchecked those boxes before clicking Next, eh?"
