I'm hoping that the Democrats obstruct any and all nominees of Bush's until Bush is no longer in office. Fuck it. It's worth it to keep him from appointing a Justice to the SCOTUS.
There's simply no chance that a Bush appointee will be prevented from entering the halls of the Supreme Court of the United States. One way or another, it's going to happen. And even if it turns out that Bush, against all precedent, appoints someone well respected by everyone -- that person will be a conservative. Likely an unapologetic one.
Which means that the balance on the Supreme Court moves as such: Conservative: Scalia, Thomas, Rehnquist, X Swing: Kennedy Liberal: Souter, Breyer, Ginsberg, Stephens
It takes two-thirds of the Senate to approve a SCOTUS Justice (unless I'm missing an admendment) ... I don't see how the Democrats can't keep anybody Bush nominates from getting the seat, as long as they're not spineless. Oh, wait. What am I saying?
Well, according to the Constitution, it requires 2/3 of the Senate to approve an appointment to the SCOTUS. Ok, wait. I misread that. The 2/3 things is for treaties ... it's only the "advice and consent of the Senate" for SCOTUS Justices, which means a simple majority.
