Well, it doesn't *have* to come back, either. They're planned to be going by the ISS, after all. If it can't reenter, they can leave it there permanently, and put something useful in the cargo bay.

And send up something else to get the astronauts down. Hell, call the Russians and borrow on of their cosmonaut-shuttling rockets.

Hell, just send one of those ISS-crew-relief rockets up. Plus the ISS already has a 'lifeboat' reentry Soyuz they could probably use, though it'd have to be replaced of course.
