In the USA, the National Guard is divided by state, and answers to the state's Governor, not to the President.

In Vermont, 48 towns voted last night to condemn the war in Iraq and bring the National Guard of Vermont home. 3 towns have voted against the motion, and 3 have tabled it for later discussion.

Vermont has lost more soldiers per capita than any state, and has the second highest mobilization rate for its National Guard and reservists.

That's cool.. i was wondering about why so many NG units got sent and no Govenors complained. I mean the main purpose of th eNG was for the state and to serve it's needs, especially in case of a disaster...

I wonder if the USSC is going to interpret it in that manner.
US Constitution, Section. 2. Clause 1: The President shall be Commander in Chief of the Army and Navy of the United States, and of the Militia of the several States, when called into the actual Service of the United States[.]
I'd bet that the National Guard is the Militia and from an initial look at it, it's the President, not the Governors, who decides what the National Guard does once the NG is called into service on behalf of the entirety of the US, as opposed to help with some natural disaster within its State.

If the National Guard is the Militia, anyone *not* in the NG doesn't have the right to keep and arm bears. So that definition is never going to fly.
